Title: List of EWC bodies that have been replaced by another one

Reference language: no information

Notes:

The table contains cases of EWCs that were replaced by another EWC as a consequence of companies taking over each other or merging. In case of a take over it is a common procedure (though not necessarily the only solution) that the EWC in the acquired company ceases to exists and employee representatives are included into the EWC of the company that performed the take over. In case of companies merging the decision which EWC should continue to exist is often decided upon the question which EWC is based on art. 13 of the Directive 94/45/EC: usually an Art. 13 EWC replaces an Art. 6 EWC due to the flexibility offered by the so called anticipatory agreement (i.e. Art. 13 agreement). There are, however, no rigid rules governing these processes and it is a decision of managements (and more rarely of EWCs).
