In a ruling rendered on December 6 following on a German case, the European Court of Justice limits the ability for the company's social partners to change the amount of termination benefits depending on the interested party's possibility of receiving a retirement pension for severely disabled persons. The Court ruled that it was equal to discrimination on the grounds of disability. It also had to answer a question about the presence of discrimination on the grounds of age when the termination benefits depend on the age of possible ordinary old-age pension. In this case, the Court stated that different treatment could be justified. (Ref. 120727)
