On January 28, the Court of Appeal of Paris rendered a decree ordering the suspension of the ongoing restructuring procedure at PSA Group until the employee representation structures of its Faurecia subsidiary have been properly informed and consulted. In September, the part manufacturer's CGT union commenced ex parte proceedings against the manufacturer to ask for the suspension of the restructuring plan launched in July before seizing the subsidiary's employee representation structures and properly informing PSA's EWC. The plaintiffs secured the suspension of the plan until Faurecia's structures have been properly informed and consulted. However, the Court ruled that Faurecia's unions are not competent to request the suspension of the restructuring to secure compliance with the EWC's information/consultation procedure. Only the EWC is allowed to criticize the relevance and faithfulness of information provided by the management. (Ref. 130073)
