Still with a view to making the agreements negotiated under Directive 2009/38 available, we are publishing this new agreement signed by DS Smith (packaging) on March 4. Its characteristic is that it is still a derogatory "anticipation agreement" in spite of an in-depth renegotiation because of a large takeover and the introduction of all the new points of the recast directive. Indeed, it is the result of the takeover of the packaging operations of SCA (Sweden) in July 2012. The point is to mix DS Smith's agreement (UK law) and the packaging unit of SCA, which had its own EWC agreement (Swedish law). (Ref. 130179)
