In a decision handed down on 11 June by the Barcelona labour court (here in Spanish), it was ruled that the company had sacked nine delivery riders from its platform. Deliveroo was also ordered to readmit the workers and to pay each of the riders concerned €6,251 in damages for “violation of fundamental rights”, particularly the right to organise, as well as further sums for outstanding vacations. The court highlighted that, among other things, the process of allocating time slots or shifts demonstrates that the company has made real organisational and management decisions impacting these delivery riders, including as regards their remuneration. Meanwhile the various ‘recommendation’ SMS messages sent were simply a way of exercising disciplinary power in different forms. The judgement recognises the link between the protest movement of the plaintiffs and the termination of their relationship with the platform, and therefore overturned their dismissals.
